Bequest Should Have Been Sent to Pacifica!"},"content":{"rendered":"<p>By:\u00a0 UCR Candidate <a href=\"http:\/\/www.unitedforcommunityradio.org\/?p=2952\">Sharon Adams<\/a><\/p>\n<p>Our opponents have been claiming that United For Community Radio &#8220;<a href=\"http:\/\/www.savekpfa.org\/lsb-member-janet-kobren-costs-kpfa-400000\/\">cost KPFA $400,000<\/a>&#8220;, implying that KPFA was actually entitled to a <a href=\"http:\/\/www.unitedforcommunityradio.org\/?p=3710\">$400,000 bequest<\/a>.\u00a0 Of course, that is the exact issue &#8212; KPFA was not entitled to the $400,000 bequest &#8212; the Pacifica Foundation was entitled to this bequest.\u00a0 Our opponents inappropriately decided, WITHOUT CONSULTING PACIFICA, that this bequest was intended solely for KPFA.\u00a0 The reason we know that KPFA was not entitled to the $400,000 bequest is because the Pacifica National Board (PNB) has <a href=\"http:\/\/pacifica.org\/documents\/pnb_exec_151029.pdf\">determined<\/a> that the bequest was actually supposed to go to Pacifica.<br \/>\n<a href=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/Bequest_Check.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignright size-medium wp-image-3859\" src=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/Bequest_Check-300x110.jpg\" alt=\"Bequest_Check\" width=\"300\" height=\"110\" srcset=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/Bequest_Check-300x110.jpg 300w, http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/Bequest_Check.jpg 446w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>The PNB&#8217;s decision is supported by the evidence.\u00a0 First and foremost, both the <a href=\"http:\/\/www.mediafire.com\/view\/g37ahajfzc5b1th\/Nalbandian_will.pdf\">bequest<\/a> and the <a href=\"http:\/\/www.mediafire.com\/view\/64zc7dcbx3l4t2l\/Hall_check_and_deposit_slip.pdf\">check<\/a> were specifically made out to &#8220;Pacifica Foundation Radio&#8221;.\u00a0 There was no mention of KPFA in the bequest documents.<\/p>\n<p><a href=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/08\/Pacifica-Logo.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignleft size-thumbnail wp-image-3231\" src=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/08\/Pacifica-Logo-150x150.jpg\" alt=\"Pacifica Logo\" width=\"150\" height=\"150\" \/><\/a>And, even assuming there was ambiguity in the identification of Pacifica Foundation Radio, the proper response would have been to contact the PNB to mutually discuss and decide how to deal with the bequest.\u00a0 It was our opponents <strong><em>failure to ask Pacif<\/em><em>ica<\/em> <em>that is at the heart of this matter<\/em>.<\/strong>\u00a0\u00a0 To the extent that our opponents felt there *was* ambiguity, they should have checked with the Pacifica National Board.<\/p>\n<p>Interim Executive Director (and SaveKPFA candidate) Margy Wilkinson later <a href=\"http:\/\/pacificainexile.org\/archives\/1455\">apologized<\/a> for this failure to disclose &#8212; after the fact and when the bequest funds were already comfortably residing in the KPFA bank account.\u00a0 It really would not have been that difficult to send this information to Pacifica prior to depositing the check in the KPFA bank account.<\/p>\n<div id=\"attachment_3862\" style=\"width: 757px\" class=\"wp-caption aligncenter\"><a href=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/FBOKPFA.jpg\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-3862\" class=\"wp-image-3862 size-full\" src=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/FBOKPFA.jpg\" alt=\"FBOKPFA\" width=\"747\" height=\"152\" srcset=\"http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/FBOKPFA.jpg 747w, http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/FBOKPFA-300x61.jpg 300w, http:\/\/www.unitedforcommunityradio.org\/wp-content\/uploads\/2015\/11\/FBOKPFA-500x102.jpg 500w\" sizes=\"auto, (max-width: 747px) 100vw, 747px\" \/><\/a><p id=\"caption-attachment-3862\" class=\"wp-caption-text\">~Screen shot of kpfa.org website<\/p><\/div>\n<p>As the image above shows, it is quite easy to make a bequest that is for KPFA, and the <a href=\"https:\/\/kpfa.org\/donate\/create-your-own-legacy\/\">KPFA website provides clear instructions<\/a> on how to do this.\u00a0 Of course, Pacifica must be mentioned in the bequest instructions because Pacifica is the parent organization of KPFA.\u00a0 Significantly, the KPFA website makes clear that the phrase &#8220;for the benefit of KPFA&#8221; or &#8220;fbo KPFA&#8221; must be added.\u00a0 This is not difficult to do, and is standard operating procedure for attorneys working in estate planning who are trained to make clear and unambiguous bequests.<\/p>\n<p>Now that our opponents have been exposed, they start the mudslinging, with personal attacks on UCR candidate Janet Kobren who found the documents showing that the bequest was intended for the Pacifica Foundation.\u00a0 However, Janet Kobren was simply doing her duty as a <a href=\"https:\/\/kpfa.org\/about\/pacifica-national-board\/\">board member and secretary of the PNB<\/a>.\u00a0 This is in stark contrast to other KPFA members on the PNB, Brian Edwards-Tieckert and Margy Wilkinson.\u00a0 They have shown that they are willing to &#8220;Save&#8221; KPFA &#8212; at the expense of the entire Pacifica network.<\/p>\n<p>United for Community Radio is not into assigning blame.\u00a0 UCR wants to ensure that the entire Pacifica network remains strong, including KPFA and its sister stations.\u00a0 UCR&#8217;s opponents must stop cannibalizing Pacifica to allegedly &#8220;Save&#8221;
